Description

Potential for the construction of a Residence or Tourism in a Rural Area (TER).
The construction of the owner-farmer's own residence of the agricultural holding is authorised, subject to the following conditions:
1-The applicant is a farmer, under the terms of sectoral regulations, responsible for the agricultural holding and owner of the building where the dwelling is to be located, a fact that must be proven by the competent authorities;
2- The buildings that constitute the agricultural holding on which the building is located are inalienable for a period of 10 years following the construction, except for debts related to the acquisition of real estate of the holding and of which the holding is a guarantee, or for tax debts, this burden being included in the land registry of the dwelling. This burden does not apply when the transfer of any rights in rem over these buildings occurs between farmers and as long as the allocation of the building to the exclusive use of the dwelling for the farmer's own residence is maintained. Buildings to support agricultural activity; Installation of industrial establishments as long as they are compatible with the activity associated with the class of space.
3- Under the conditions of the previous paragraph, the installation of tourist activities in the form of TER is also permitted.
4 - The expansion of existing buildings is allowed as long as they comply with the provisions of the corresponding urban parameters and maintain the main use of the property, except in the case of installation of TER projects.
5 - The TER developments will have the following parameters: a) Rural Hotel: floors 2; b) Others: if the existing building is greater than or equal to 350 m², its expansion may be 30%, if the existing building is less than 350 m², its expansion may be up to 500 m².
6 - The construction of buildings to support agricultural activity is allowed, in cases where the applicants do not have the minimum area of the building, provided that the gross construction area does not exceed 60 m².
7 - It is allowed to change the height of the maximum façade, defined in paragraph 2 of article 16, paragraph 2 of article 17, article 19 and article 21, to 6.5 m in duly justifiable cases.
8 - All buildings, regardless of their use, must have a good integration into the landscape, avoiding landfills or excavations with cuts greater than 3 m.
9 - Under exceptional conditions, and duly justified economically and socially, the City Council may allow the installation of industrial activities indirectly linked to the use of the land, provided that they comply with the applicable legislation, do not represent negative environmental impacts and represent an effective economic value for the municipality.
10 - The water supply and sewage network are the responsibility of the interested party, and connections to the public network are mandatory whenever it exists on site or nearby.
11 - The installation of dumps, landfills or other concentrations of solid, liquid or gaseous waste and scrap yards is prohibited. Any actions that create risks of contamination of aquifers are also prohibited
